The documents generated by this service are templates based on publicly available California traffic law and are intended to assist you in preparing your own written submission. They do not constitute legal advice, do not create an attorney-client relationship, and should not be relied upon as a substitute for advice from a licensed California attorney. Results vary based on facts, court, and judicial discretion.

These Terms of Service ("Terms") govern your access to and use of ticketcleared.com and the document generation service offered by TicketCleared ("we," "our," or "us"). By using the service you agree to these Terms in full. If you do not agree, do not use the service.

1. Eligibility

TicketCleared is available only to individuals who:

  • Are California residents contesting a California traffic citation
  • Are 18 years of age or older
  • Are using the service for their own personal ticket, not on behalf of another person without their knowledge
  • Are not using the service for commercial or resale purposes

The Trial by Written Declaration process (California Vehicle Code Section 40902) applies to eligible infraction-level traffic tickets. It is your responsibility to confirm your ticket is eligible before purchasing. We do not issue refunds solely because a ticket turns out to be ineligible for TBWD.

2. Description of Service

TicketCleared provides an automated document generation service. Upon completing the intake questionnaire and paying the one-time fee, you receive:

  • A personalized Defendant Declaration for use in a California Trial by Written Declaration
  • A Witness Declaration (if you indicated a passenger was present)
  • For eligible paper filings, a combined PDF containing the official TR-205 with defendant fields completed and the declaration attachments appended
  • For eligible paper filings, an optional final packet builder that can append printable evidence and a required court-notice copy without storing those enclosure files with your case
  • A separate TR-205 completion guide for verification
  • A printable case-specific filing checklist and on-screen filing instructions
  • A downloadable court-deadline calendar event with advance display alerts
  • For a potentially eligible traditional paper TBWD decision, a post-decision tool that can prefill official form TR-220 and create a separate received-by deadline calendar

Ticket files you choose to upload may be processed by OpenAI to prefill intake fields. Documents are generated using AI based on the information you provide and confirm. The quality and accuracy of your documents depends on the accuracy and completeness of your intake answers. You are responsible for reviewing all extracted fields and documents before submitting them to a court.

If you separately select the reminder option during intake, TicketCleared may send one email reminding you that an unpaid draft remains available. The reminder is optional, is not a newsletter or recurring marketing subscription, and does not change the 7-day unpaid-draft retention period described in the Privacy Policy.

If you find an inaccurate fact after unlocking your package, you may use up to three automated replacements for the same email and citation number at no additional charge while the record remains available. Each replacement overwrites the stored intake and generated documents for that package. Previously downloaded files are not changed. You must review, download, and sign the corrected version yourself. Contact support if the citation number or email must change, or if the automated replacement limit has been reached.

The final packet builder does not determine whether an uploaded page is relevant, admissible, complete, or accurate. It places files into the category you select, counts printable evidence pages on the TR-205, and excludes a court-notice copy from that evidence count. You are responsible for reviewing the assembled PDF, confirming every enclosure belongs to the citation, and following any court-specific rules for photographs, diagrams, video, or other electronic media.

The post-decision tool does not determine whether a new trial is available or whether an appeal should be filed. It is disabled for a case recorded as using a MyCitations procedure and requires court confirmation when the procedure is unknown. You must copy the Clerk's Certificate of Mailing date and every requested violation exactly from the court decision, review the prefilled TR-220, personally date and sign it, and ensure the correct court receives it before the controlling deadline. The court decision, current rules, and local instructions control.

3. Payment

The service costs $29.00 USD, charged as a one-time fee at the time of document unlock. Payment is processed by Stripe. By completing payment you authorize the charge.

There are no subscription fees, recurring charges, or hidden costs. Your $29 unlocks all documents in your package for download and the limited same-ticket factual corrections described above. Documents remain available through your confirmation email link for 12 months.

4. Refund Policy

We offer a full refund of $29 if your ticket is not dismissed as a result of your Trial by Written Declaration submission, subject to the following conditions:

  • You must have submitted the documents we generated (or documents substantially based on them) to your court as your Trial by Written Declaration.
  • You must request your refund within 180 days of your purchase date.
  • You must email raymond@ticketcleared.com with a copy or photo of your court's written decision (typically form TR-215 or equivalent court correspondence).
  • The court decision must show that the ticket was not dismissed - i.e., a guilty finding or bail forfeiture. Dismissals on unrelated procedural grounds do not qualify.

Approved refunds are processed after we review your qualifying documentation. Stripe returns funds to the original payment method according to its own processing timelines.

Non-qualifying scenarios: Refunds are not available if you (a) decided not to file, (b) filed documents you materially modified, (c) submitted the TBWD after the court deadline, (d) had your TBWD denied for procedural reasons unrelated to the document content (e.g., wrong court, filed late), or (e) request a refund more than 180 days after purchase.

TicketCleared is not a law firm. We do not provide legal advice. No attorney-client relationship is created by your use of this service.

The documents and guidance we provide are based on general information about California traffic law and the TBWD process. They are not tailored legal advice and may not account for the specific facts, procedural history, or jurisdiction-specific rules applicable to your situation. We strongly recommend consulting a licensed California traffic attorney if you have questions about your specific case, the strength of your arguments, or any procedural requirements.

Nothing on this website constitutes legal advice, and no information provided to us creates an attorney-client relationship. Reliance on information provided by TicketCleared is solely at your own risk.

6. Accuracy of Information You Provide

You agree to provide truthful, accurate, and complete information in the intake questionnaire. Documents generated by TicketCleared will reflect the facts you report. Submitting false information to a court is perjury under California law. We are not responsible for the consequences of false or misleading information you submit in your intake answers or court filings.

Any downloadable calendar event is a convenience based on a deadline you confirmed or a date you copied from a court decision. The court notice, court decision, and current court instructions control. Your calendar application, account, and device settings determine whether an alert appears, so you remain responsible for tracking and meeting every deadline.

7. Intellectual Property

The documents we generate are provided to you for your personal use in contesting your own traffic citation. You may not resell, sublicense, or use TicketCleared's templates, system design, or generated output as the basis of a competing service.

The TicketCleared website, brand, and underlying software are owned by TicketCleared and protected by applicable intellectual property law.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TICKETCLEARED AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF REVENUE, LOSS OF DATA, LOSS OF GOODWILL, OR ANY OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM (WHICH IN MOST CASES WILL BE $29.00).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU IN FULL.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY PARTICULAR OUTCOME WILL RESULT FROM USE OF OUR DOCUMENTS. WE MAKE NO GUARANTEE THAT YOUR TICKET WILL BE DISMISSED.

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of the service shall be resolved in the state or federal courts located in California, and you consent to the personal jurisdiction of those courts.

Before initiating any formal legal action, you agree to contact us at raymond@ticketcleared.com and give us 30 days to attempt to resolve the dispute informally.

11. Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms with a new effective date. For material changes, we will provide at least 14 days' notice via email (if we have your address) or a prominent notice on the site. Continued use of the service after the effective date constitutes acceptance of the revised Terms.
