What is a Trial by Written Declaration?

A Trial by Written Declaration (TBWD) is a California procedure for eligible traffic infractions. You and the officer submit written evidence for a judicial decision. A traditional paper TBWD generally permits a timely Trial de Novo request after an adverse decision. MyCitations Online Trial by Declaration does not provide that new-trial option, so the court notice and procedure displayed for the case control.

Will this work for my specific ticket?

TicketCleared currently supports California VC 22349, 22349(a), 22349(b), and 22350 speeding infractions. VC 22349 is an absolute maximum-speed charge, so favorable traffic or weather does not make exceeding that maximum lawful. VC 22350 focuses on whether the alleged speed was reasonable and prudent for the actual conditions. Unsupported charges and uncertain sections are blocked for review.

What if the officer doesn't file their declaration?

The court decides the case from the evidence submitted under the applicable procedure. An officer's failure to submit evidence may affect whether the prosecution has carried its burden, but TicketCleared does not promise automatic dismissal or predict whether an officer will respond.

Do I need a passenger / witness?

No. A witness declaration is optional and should be used only when another person personally observed relevant facts. A paper-filing user still receives the official TR-205 packet and defendant declaration without a witness.

What are my chances of winning?
